I have the honour to inform you that on the

occasion of granting leave of absence this year to Mr. Justice

Gompertz there was considerable difficulty in selecting a fit and

proper person to temporarily undertake the duties of Puisne Judge.

The funds available would not permit of the

engagement of a practising barrister and the only officers in the

service who could be considered eligible were Mr. F. A. Hazeland,

Police Magistrate, and Mr. J. H. Kemp, Crown Solicitor.

After consultation with the Attorney-General

and obtaining the views of the Chief Justice and Puisne Judge I

decided that it would be to the advantage of the service to select

Mr. Kemp for the temporary vacancy, having regard inter alia to the

difficulty at the present time of finding an officer to fill the

post of Acting First Magistrate, and I now report it specially for

your information as the appointment would seem by analogy to You violate the general ruling laid down by Lord Crewe in his Despatch 19204 No. 211 of the 28th. July, 1910. I have put on record that Mr.

Keup's appointment is made in exceptional circumstances and that it

must not be drawn into a precedent.
